SYMTRIBE — TERMS OF USE AND DISCLAIMER Last updated: 2026-02-11 Version: 1.0 BY CREATING AN ACCOUNT ON SYMTRIBE, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT CREATE AN ACCOUNT. 1. WHAT SYMTRIBE IS SymTribe is a technology platform that facilitates connections between users who share common interests in outdoor and community activities. SymTribe is NOT an event organizer, activity provider, tour operator, sports instructor, or safety supervisor. SymTribe does not plan, organize, lead, supervise, or control any activity or event. All activities are user-initiated and user-led. 2. AGE REQUIREMENT You must be at least 18 years old to create an account and use SymTribe. By creating an account, you represent and warrant that you are at least 18 years of age. 3. ASSUMPTION OF RISK Outdoor and physical activities, including but not limited to cycling, hiking, running, and group meetups, involve inherent risks including but not limited to: - Physical injury, disability, or death - Collisions with vehicles, other participants, pedestrians, or objects - Falls, equipment failure, or mechanical malfunction - Adverse weather, road, trail, or environmental conditions - Interaction with traffic, wildlife, or other hazards - Actions or omissions of other participants or third parties TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BY USING SYMTRIBE YOU ACKNOWLEDGE THESE RISKS AND VOLUNTARILY ASSUME RESPONSIBILITY FOR ANY HARM THAT MAY RESULT FROM YOUR PARTICIPATION IN ANY ACTIVITY FACILITATED THROUGH THE PLATFORM. 4. YOUR RESPONSIBILITIES You are solely responsible for: a) Determining your own physical fitness and health condition to participate in any activity. If you have any medical condition or disability, consult your physician before participating. b) Ensuring you have appropriate, well-maintained equipment (including but not limited to helmets, bicycles, safety gear). c) Evaluating the suitability and safety of any activity, route, location, and weather conditions before participating. d) Obeying all applicable laws, including traffic laws, local regulations, and rules of the road. e) Exercising your own judgment when meeting or interacting with other users, both online and in person. f) Carrying appropriate personal insurance (health, accident, and/or liability insurance). g) Your own conduct and behavior during any activity. 5. NO BACKGROUND CHECKS OR USER VERIFICATION SymTribe does NOT investigate, verify, or screen any user's identity, background, criminal history, health condition, fitness level, skill level, character, intentions, or any other information users may submit. You should not rely on SymTribe to verify the suitability or safety of any other user. You are solely responsible for determining the identity and suitability of other users you choose to interact with. 6. NO GUARANTEE OF SAFETY SymTribe does not guarantee the safety of any activity, event, route, location, or interaction facilitated through the platform. While we encourage users to report misconduct or safety concerns, SymTribe is not obligated to monitor, investigate, or take action regarding user behavior. 7. INFORMATION ACCURACY Any route information, difficulty ratings, distance estimates, terrain descriptions, meeting points, or other details provided through SymTribe (whether by the platform or by other users) are approximate and are not guaranteed to be accurate, complete, current, or suitable. Conditions may change without notice. You must independently verify all information before relying on it. 8. LIMITATION OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: a) SYMTRIBE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR PERSONAL INJURY, BODILY HARM, DEATH, EMOTIONAL DISTRESS, LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM OR PARTICIPATION IN ANY ACTIVITY. b) SYMTRIBE'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF (I) ONE HUNDRED US DOLLARS ($100) OR (II) THE TOTAL AMOUNT OF FEES PAID BY YOU TO SYMTRIBE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. c) NOTHING IN THESE TERMS SHALL EXCLUDE OR LIMIT LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, FRAUD, OR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW. 9. INDEMNIFICATION To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless SymTribe and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to: a) Your use of the platform or participation in any activity; b) Your violation of these terms; c) Your violation of any law or regulation; d) Your conduct or interactions with other users, whether online or offline; e) Any content you submit or provide through the platform; f) Any dispute between you and another user. 10. "AS IS" DISCLAIMER THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. 11. RELEASE OF CLAIMS To the maximum extent permitted by applicable law, you hereby release SymTribe and its officers, directors, employees, agents, and affiliates from any and all claims, demands, actions, and causes of action arising from or related to any loss, damage, injury, or death that may occur during or as a result of your participation in any activity facilitated through the platform. 12. PRIVACY AND CONSENT DATA When you accept these terms, SymTribe records your acceptance along with your IP address, browser information, and timestamp for the purpose of maintaining a verifiable consent record. This data is retained for the duration of your account. When you delete your account, all consent records are permanently removed along with your other personal data. For more details, see our Privacy Policy. 13. CHANGES TO THESE TERMS SymTribe reserves the right to modify these terms at any time. If we make material changes, we will notify you through the platform and require your renewed acceptance before you can continue using the service. Your continued use after accepting updated terms constitutes agreement to the revised terms. 14. GOVERNING LAW These terms are governed by the laws applicable in the jurisdiction where the entity operating SymTribe is established. If you are a consumer in the European Union or European Economic Area, nothing in these terms affects your rights under mandatory consumer protection laws of your country of residence. Any dispute arising from these terms shall be submitted to the competent courts in the jurisdiction where the entity operating SymTribe is established, without prejudice to any mandatory legal provisions granting you the right to bring proceedings in the courts of your country of residence. 15. SEVERABILITY If any provision of these terms is found to be unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed.
